1. Agreement to Terms 

These Terms and Conditions (“Terms”) govern your use of services provided by PORTAL XPRESS (“we,” “us,” or “our”) for shipping goods from the United States to Jamaica. By engaging our services, you (“Customer”) agree to these Terms.

 

2. Services Provided 

We offer freight forwarding, logistics, and related services, including the arrangement of shipment from the U.S. to Jamaica, customs brokerage, and delivery within Jamaica (collectively, “Services”).

 

3. Rates and Fees  

All rates quoted are estimates based on the information provided at the time of booking. Final charges may vary depending on factors such as actual weight, dimensions, contents, destination, and applicable fees. Any additional costs arising from delays, storage, or handling will be the Customer’s responsibility. Payment is due upon delivery unless otherwise agreed upon in writing.

 

4. Duties, Taxes, and Customs Clearance  

All shipments to Jamaica are subject to Jamaican Customs regulations. The Customer is responsible for any applicable customs duties, taxes, and associated fees. PORTAL XPRESS will assist in customs clearance but cannot guarantee release times. Failure to comply with customs regulations may lead to fines, delays or confiscation, for which we are not liable.

 

5. Shipping and Delivery  

While we aim to provide accurate delivery estimates, these are not guaranteed and may vary due to factors beyond our control, including customs processing, weather, and port delays. We are not liable for any delays.

 

6. Insurance

Insurance coverage is not included in our standard rates. If the Customer wishes to insure a shipment, they must request and pay for additional coverage in advance. We will not be responsible for any damage, loss, or theft of uninsured shipments beyond the limitations outlined in these Terms.

 

7. Limitation of Liability  

a. Damage or Loss: We are not liable for any damage or loss that occurs due to improper packaging or any cause beyond our control, including natural disasters and acts of government.  

b. No Consequential Damages: We are not liable for any consequential damages, such as lost income, business disruption, or emotional distress resulting from delays, damage, or loss.

 

8. Packaging and Labeling  

The Seller is responsible for ensuring that all items are properly packaged, labeled, and secured. Failure to do so may result in damage or loss, for which we are not responsible.

 

9. Restricted and Prohibited Items  

Certain items are restricted or prohibited from shipping to Jamaica due to Jamaican law and customs regulations, including firearms, hazardous materials, and perishable goods. The Customer agrees not to ship any prohibited items. If prohibited items are identified, we reserve the right to reject, dispose of, or report the shipment to relevant authorities.

 

10. Right to Refuse Service 

We reserve the right to refuse service to any shipment that violates these Terms, contains prohibited or hazardous materials, or is deemed unsafe or illegal by our team or local authorities.

 

 

12. Modifications to Terms 

We may amend these Terms at any time, with updates posted on our website. Continued use of our Services after any changes will constitute acceptance of the new Terms.
